Welcome to BritishPay. These Terms and Conditions (“Terms”) set out the rules for using our website www.britishpay.co.uk and the BritishPay mobile application (together, the “Services”). By accessing or using our Services, you agree to these Terms. If you do not agree, you must not use our Services.

2. Using Our Services

You must be at least 18 years old to use BritishPay.

You must be a UK resident at the time of registration.

You are responsible for keeping your login details secure.

You must complete identity verification (KYC) before accessing all features.

You agree to use our Services only for lawful purposes and not for any fraudulent, illegal, or harmful activity.
Definitions

“BritishPay” – BPay UK Ltd, a technology service provider and payment facilitator.

“Griffin Bank” – BritishPay’s payment accounts and safeguarding are provided by Griffin Bank, a UK bank authorised by the Prudential Regulation Authority (PRA) and regulated by the Financial Conduct Authority (FCA).

“User”, “you” – the individual, merchant, charity, or organisation using BritishPay services.

“QR Payments” – donations or transactions made by scanning a BritishPay QR code.

“Tap to Pay” – in-person contactless card or mobile wallet payments using BritishPay’s Tap on Mobile service.

App: The BritishPay mobile and web application.

Wallet: An electronic balance held within the App.
-
User: An individual using the Wallet for personal payments.

Merchant: A business or sole trader using the App to accept payments.

Transaction: A payment, top-up, or withdrawal processed through the App.
Prohibited Uses
You may not use the App for:

Fraud, money laundering, or illegal activities.

Gambling, adult content, or other restricted industries without our written consent.

Transactions designed to avoid fees.
Our Services

BritishPay provides a platform that enables individuals, merchants, charities, and community organisations to accept payments.

BritishPay is not a bank, not an EMI, and does not itself hold customer funds.

Personal Users may: hold wallet balances, send/receive payments, request payments, and withdraw to their bank.

Merchants may: generate QR codes, accept wallet payments, and withdraw funds to their bank.

Supported top-up methods:

Bank transfer (Griffin)

Open Banking (Griffin)

Debit/Credit Card, Apple Pay, Google Pay

Top-ups & Withdrawals
-
Top-ups via Open Banking and cards are generally instant. Bank transfers may take up to 2 business days.

Withdrawals are normally processed on the same business day but may take up to 2 days depending on the receiving bank.
-
Limits: daily and monthly caps may apply to top-ups, payments, and withdrawals.
3. Accounts and Security

To access certain features, you may be required to create an account.

You agree that all information provided is accurate and kept up to date.

We may suspend or close your account if we suspect misuse, fraud, or breach of these Terms.
Merchant Responsibilities

Only accept payments for legitimate goods and services.
-
Comply with UK consumer law, including refunds and chargebacks.

Maintain accurate business details in your account.
Security & Compliance

We use device binding, 2FA, and biometric login where available.
-
We comply with AML (Anti-Money Laundering) and KYC regulations.

We may suspend or close accounts if suspicious activity is detected.
4. Fees and Payments

Some Services are free; others may include fees as set out on our website or app (see Pricing page).

Fees may change from time to time. We will notify you in advance of any material changes.

Any bank charges or third-party fees (e.g. card providers) are your responsibility.

Fees are deducted from payments before settlement (except QR donations for charities, which are fee-free).
Charities & Community Organisations

QR code donations for registered charities, temples, churches, mosques, gurdwaras, and non-profit organisations are free of charge.

Tap to Pay donations are subject to the standard BritishPay in-person transaction fee (currently 0.8%).

Eligibility for charity pricing requires proof of charitable or non-profit status.
5. Intellectual Property

All content on this website and app (logos, text, graphics, software) belongs to BPay UK Limited or our licensors.

You may not copy, reproduce, or distribute our content without prior written permission.
6. Third-Party Links and Services
Our website or app may include links to third-party websites or services. We are not responsible for the content, accuracy, or practices of these third parties.
7. Limitation of Liability

We do not guarantee that the Services will always be available, uninterrupted, or error-free.

To the maximum extent permitted by law, we are not liable for:

Losses not caused by our breach;

Business losses (including loss of profit, revenue, goodwill);

Losses arising from events outside our reasonable control.

8. Termination
We may suspend or terminate your access if you breach these Terms or misuse our Services. You may stop using our Services at any time by closing your account.
9. Governing Law
These Terms are governed by the laws of England and Wales. Any disputes will be subject to the exclusive jurisdiction of the courts of England and Wales.
10. Changes to These Terms
We may update these Terms from time to time. The updated version will always be available on this page with the “last updated” date. Continued use of our Services means you accept any updated Terms.
Bank Accounts & Safeguarding

When you add funds or receive payments through BritishPay, your money is held in a safeguarded account provided by Griffin Bank, a UK bank authorised by the Prudential Regulation Authority (PRA) and regulated by the Financial Conduct Authority (FCA) and the PRA.

Funds are held in bank accounts, not as electronic money.

All customer funds are kept separate from BritishPay’s operational funds and are safeguarded in accordance with UK banking regulations.
-
Funds held with Griffin Bank are protected under UK banking law, not the Electronic Money Regulations 2011.
-
Funds do not earn interest.
